Agreement of Rent Executed at Chennai,
5th day of October, 2019, between, Mr.R.Parthasarathy, S/o.Late
V.Ramaswamy aged about 69 years, Cell No.8148111951,residing at D-103, First
floor, The Metrozone,44,Pillaiyarkoil St., Jawaharlal Road, Anna Nagar,
Chennai-40, herein after called LESSOR (expression shall, wherever
the context so permit mean and include his heirs, executors, administrators and
legal representatives and assigns)
Or the party of the 1st Part
And
Mr.Gopinath (alias)Apputta Iyengar, S/o. Late Kannan, aged about 50 years
Cell( No.9841076490 and Mr.K.Sairam (alias)
K.Sriram Iyengar, S/o. Late Kanan, aged about 37 (Pan No.IEAPS626
1B) CELL NO.9840451287 Residing at No.9/119, B type, 46th Street, (Behind
Kamatchi Ammankoil,Sidco Nagar, Villivakkam Chennai49, herein after called
the LESSEE (which expression shall,wherever the context, so permits, mean
and include his successors, administrators, legal representatives and assigns.)
are the Party of Second Part.
WHEREAS , the LESSOR has agreed to lease out
and the Lessee has agreed to take the Ground Floor Property on rental
basis (herein after called Schedule A
NOW, THIS AGREEMENT OF THE
RENTAL WITNESSETH :
1. The Lease shall commence from 5th
October,2019, initially for a period of 11
months.
(i) The rent for the premises shall
be Rs.15,000/- (Rupees Fifteen thousand only )
per month. As per Schedule A for first 11
months, commencing from 5th
October,2019 to 5th Septmber,2020.
(ii) The rent from 5th
September, 2020 to 5th August 2021, the rent will be
Rs.15,500/- per month (Rupess
Fiften thousand five hundred only). If the
Lease is extended for
further period of 11 months, at the option of Lessor.
2. The Lessee has paid a Sum
of Rs. 1,50,000 ( One Lakh fifty thousand only) paid
towards interest free deposit, which
shall be refunded by the Lessor to the Lessee on
termination of Lease or at the time
of vacating the demised premises after deducting
the cost of any damages caused
to the demised premises due to negligence of the
Lessee normal wear and tear excepted.
3.
The Rent stipulated shall be to
paid to the Lessor every English Calendar
Month on or before 05th of every month. The party of the
Second part is requested to pay the same
by way of fund transfer in favour of Lessor to ICICI Bank. Anna Nagar, Saving
Bank / Her Account No.168301510391, IFSC Code No.ICIC0001683.
4.
The Lessor has agreed to give vacant
possession of the demised premises on 5th Oct 2019 and the tenancy
shall commence from that date.
5.
The Municipal
property tax and other taxes on the property on the demised
premises shall be paid by the Lessor.
6.
During the period of Lease, the Lessor or
the Lessee can terminate the lease by giving Six Months notice in writing.
During the period covered by such notice, the lessee shall allow the lessor to
show the demised premises, by prior appointment, during the day time to
prospective tenants. If the Lessee break the Lease without a six months written
notice or before the lease period is over, the Lessee agree to pay for the
remaining months ’rent left on the lease.
7. The
Lessee is permitted to park their Two Wheeler inside the Premises.
8.
Electricity and Water charges shall be
paid by the Lessee periodically as per bills received.
9.
The monthly maintenance charges for the
demised premises as per Schedule A will be shared 50% on actual basis.
10.The Lessor or
his authorized representative shall have the right to inspect the demised
premises whenever necessary. During reasonable hours in day time on the due
notice being given to the Lessee in order to examine the state and condition of
the demised premises,
11No structural
alteration of any kind to the demised premises or any part thereof may be
carried it out by the Lessee without the prior permission in writing of Lessor.
12.The Lessee
undertake to maintain the demised premises in good condition, reasonable wear
and tear excepted. The Lessee will be responsible for carrying out all minor
maintenance with the demised premises, which will be limited to repairs such as
leaking
13.The Lessee agrees not assign or under let
or sublet or part with the possession of the demised premises or any part
thereof and also agrees not to earn,' on any offensive trade or prohibited
business and not to store any combustible or explosive substance.
14. The Lessee agrees to deliver possession of the
demised premises on the expiry of Lease as stipulated in this agreement in a
good condition as it was, when the Lessee obtained possession, reasonable wear
and tear being expected.
